Welcome to The Last Lamplight.
These Terms & Conditions (“Terms”) govern your access to and use of The Last Lamplight website (the “Site”) and any purchase made through the Site.
The Last Lamplight is owned and operated by Online Avenue Holdings LLC, a limited liability company organized under the laws of the State of Wyoming (“The Last Lamplight,” “we,” “us,” or “our”).
By accessing the Site, creating an account, or placing an order, you agree to these Terms. If you do not agree with these Terms, please do not use the Site.
1. About The Last Lamplight
The Last Lamplight specializes in retired, discontinued, run-out and hard-to-find Lemax collectible village products.
Our inventory primarily consists of products that are no longer part of the manufacturer’s current product range. Unless expressly stated otherwise, The Last Lamplight does not sell Lemax products released after 2025.
Because many products are discontinued and increasingly difficult to source, quantities are limited and replacement stock may not be available.
The Last Lamplight is an independent retailer. Unless expressly stated otherwise, we are not affiliated with, endorsed by, sponsored by, or operated by Lemax or its related entities. All manufacturer names, trademarks and product names remain the property of their respective owners.
2. Product Condition and Older Inventory
Unless otherwise stated in the product description, products are sold as new or unused merchandise.
However, customers acknowledge that many products offered by The Last Lamplight are older or new-old-stock collectibles that may have been manufactured, packaged or originally distributed many years ago.
As a result, outer packaging may show reasonable signs of age, storage or handling, including minor:
- fading or discoloration;
- scuffing;
- creasing;
- shelf wear;
- price-label or adhesive residue;
- deterioration of cardboard or plastic packaging; or
- changes in manufacturer packaging between production runs.
Minor packaging deterioration that is consistent with the age of a discontinued product does not necessarily indicate that the product itself is defective.
Where we are aware of significant damage or a material defect affecting an item, we will endeavor to disclose this in the product listing.
Customers for whom the condition of the original retail packaging is particularly important are encouraged to contact us before ordering.
3. Product Images and Descriptions
We make reasonable efforts to ensure that product descriptions, specifications and images are accurate.
Product images may include manufacturer-supplied images, catalog images, stock photographs or representative photographs and therefore may not always depict the exact individual item that will be supplied.
Manufacturers occasionally make changes to packaging, paintwork, accessories, electrical components or other minor details during a product’s production life without changing the product number.
Colors may also appear differently depending upon your screen or device.
If a particular packaging style, production variation or other characteristic is important to you as a collector, please contact us before placing your order.
4. Availability of Retired Products
Because we specialize in discontinued merchandise, many products are available only in very limited quantities.
Adding an item to your shopping cart does not reserve the item.
All orders are subject to availability and final confirmation.
Although we maintain inventory records carefully, occasional inventory discrepancies may occur. If an ordered product cannot be located or supplied, we will notify you and refund any amount paid for that unavailable product.
We are not responsible for obtaining a replacement discontinued product where additional stock is unavailable.
5. Pricing
All prices displayed on the Site are stated in United States Dollars (USD) unless otherwise indicated.
Prices may change without notice.
The price applicable to an order is normally the price displayed when the order is submitted.
We reserve the right to correct genuine typographical, technical, pricing or inventory errors.
If a material pricing error is discovered after an order has been placed, we may contact you and offer the opportunity to proceed at the correct price or cancel the affected item for a full refund.
6. Sales Tax
Applicable sales taxes will be calculated and collected where required by federal, state or local law.
The amount of tax charged may depend upon the customer’s delivery address and applicable tax rules at the time the order is processed.
7. Orders and Acceptance
Submitting an order through the Site constitutes an offer to purchase the products in that order.
An automated order confirmation acknowledges that we have received your order but does not necessarily constitute final acceptance of the order.
We reserve the right to decline or cancel an order where reasonably necessary, including where:
- an item is unavailable;
- an incorrect price or description has been published;
- payment cannot be authorized;
- we reasonably suspect fraudulent or unauthorized activity;
- delivery cannot reasonably be completed to the address supplied; or
- fulfillment of the order would violate applicable law.
If we cancel an order after payment has been received, the applicable payment will be refunded.
8. Payment
Payment must be made using one of the payment methods displayed during checkout.
Payments may be processed by third-party payment providers. We do not normally receive or store your complete payment-card information.
You represent that you are authorized to use the payment method supplied with your order.
Orders may be held or cancelled if payment authorization cannot be completed or if additional verification is reasonably required to protect against fraud.
9. Shipping
Orders are shipped using the carriers and shipping services available at checkout or otherwise selected by The Last Lamplight.
We reserve the right to use an alternative carrier or equivalent shipping service where reasonably necessary.
Shipping charges, where applicable, will normally be displayed during checkout before payment.
Delivery estimates are estimates only and are not guaranteed delivery dates unless expressly stated otherwise.
Once a shipment has been transferred to the carrier, circumstances such as weather, transportation disruptions, carrier delays and peak-season parcel volumes may affect delivery times.
Please ensure that your shipping address is complete and accurate before submitting your order.
Additional costs resulting from an incorrect or incomplete address supplied by the customer may be the customer’s responsibility to the extent permitted by law.
10. Tracking and Delivery
Where tracking is available, tracking information will normally be provided after shipment.
Customers are responsible for monitoring tracking information and ensuring that packages can be safely received at the delivery address supplied.
If tracking shows a package as delivered but you cannot locate it, please contact us promptly so that we can assist with the carrier’s investigation.
Carrier investigations and claims may take time to complete.
Nothing in this section limits any rights you may have under applicable law.
11. Inspection of Your Order
Please inspect your order promptly after delivery.
If an item arrives damaged, defective, incomplete or materially different from the item ordered, please contact us as soon as reasonably possible and provide:
- your order number;
- a description of the problem;
- photographs of the item;
- photographs of any damaged packaging; and
- photographs of the shipping carton where relevant.
Please retain the product, original packaging, shipping carton and packing materials until we advise you that they may be discarded, as the shipping carrier may require them when processing a damage claim.
12. Damaged or Defective Products
If a product arrives damaged or defective, please contact us before returning it.
Depending upon the circumstances and availability of discontinued inventory, we may offer an appropriate remedy such as:
- replacement;
- replacement components where available;
- refund;
- partial refund where agreed with the customer; or
- another mutually acceptable resolution.
Because many products sold by The Last Lamplight are retired or discontinued, an identical replacement may not always be available.
Where an appropriate replacement cannot reasonably be supplied, a refund may be provided instead.
13. Returns and Change of Mind
Please contact us before returning any product.
Unless otherwise stated on the product listing, requests to return an item for reasons other than damage, defect or an error by The Last Lamplight should be made within 7 days after delivery.
Returned products must ordinarily be:
- unused;
- complete;
- in substantially the same condition in which they were received; and
- returned with their original product packaging, accessories and components.
For discretionary or change-of-mind returns, the customer is responsible for return shipping costs unless otherwise agreed.
Original shipping charges are generally non-refundable on discretionary returns except where required by law.
We recommend using a tracked and adequately insured shipping service when returning collectible merchandise.
This section does not limit any non-waivable consumer rights available under applicable law.
14. Unauthorized Returns
Please do not return merchandise without first contacting us.
An unauthorized return may delay processing because we may be unable to identify the order or reason for the return.
Packages marked “Return to Sender,” refused deliveries, or packages returned because of an incorrect address may be treated as discretionary returns, subject to applicable law and any shipping or carrier charges incurred.
15. Promotions and Discount Codes
Promotional offers, discount codes and special pricing may be subject to additional conditions.
Unless otherwise stated:
- promotions cannot be combined;
- discounts cannot be applied retrospectively;
- promotional codes have no cash value; and
- promotions may be modified or withdrawn before an order is placed.
Orders already accepted will not normally be affected by the subsequent expiration or withdrawal of a promotion.
16. Accounts
You may be permitted to create a customer account.
You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.
Please notify us promptly if you believe your account has been accessed without authorization.
We may suspend or terminate an account where reasonably necessary to prevent fraud, misuse, security risks or violations of these Terms.
17. Intellectual Property
Unless otherwise indicated, the Site and its original content, layout, graphics, branding, written material and other original materials are owned by or licensed to The Last Lamplight and are protected by applicable intellectual-property laws.
Manufacturer names, product names, photographs, trademarks and other intellectual property belonging to third parties remain the property of their respective owners.
Nothing on this Site grants you ownership of or a license to use intellectual property belonging to The Last Lamplight or any third party except as necessary for your personal use of the Site.
18. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
WE DO NOT MAKE WARRANTIES REGARDING THE UNINTERRUPTED OR ERROR-FREE OPERATION OF THE SITE OR THE FUTURE COLLECTIBLE OR RESALE VALUE OF PRODUCTS.
THIS DISCLAIMER DOES NOT EXCLUDE WARRANTIES, GUARANTEES OR OTHER RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.
19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LAST LAMPLIGHT AND ONLINE AVENUE HOLDINGS LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS.
WHERE LIABILITY CANNOT LAWFULLY BE EXCLUDED, OUR LIABILITY WILL BE LIMITED ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
20. Fraud and Misuse
We reserve the right to investigate transactions that reasonably appear fraudulent, unauthorized or abusive.
Orders may be delayed or cancelled while reasonable fraud-prevention checks are completed.
We may cooperate with payment providers, shipping carriers and law-enforcement authorities where reasonably necessary or legally required.
21. Privacy
Personal information collected through the Site is handled in accordance with our Privacy Policy.
Our Privacy Policy should be read together with these Terms.
22. Governing Law
These Terms and your use of the Site are governed by the laws of the State of Wyoming, without regard to its conflict-of-law principles, except where applicable federal law or another jurisdiction’s mandatory consumer-protection laws apply.
Any dispute arising from these Terms or your use of the Site will be subject to the jurisdiction of the appropriate courts having jurisdiction under applicable law.
Nothing in these Terms is intended to deprive a consumer of any rights or protections that cannot legally be waived.
23. Changes to these Terms
We may update these Terms periodically to reflect changes to our operations, services, legal requirements or business practices.
The revised Terms will be posted on this page with an updated “Last Updated” date.
Changes will apply prospectively unless applicable law requires otherwise.
